Terms of service
These terms are an agreement between you and TCHENTCHEN LLC (“Tchentchen”, “we”). They apply when you create a Tchentchen account, install a Tchentchen plugin or otherwise use the service. If you use Tchentchen for a business, you accept these terms for that business and confirm that you may do so. If you do not agree with them, do not use Tchentchen.
If you are a shopper: your purchase is made with the store, under the store’s own terms. Tchentchen only provides the checkout technology. For a question about an order, contact the store you bought from.
1. The service
Tchentchen embeds Stripe’s checkout in your online store through a plugin (today for PrestaShop), with delivery and taxes calculated from your store’s rules, upsells, and a one-click offer after the purchase, all in one order. You manage it from your account on app.tchentchen.com. You can use it in Stripe’s test mode before you take real payments. The features may change over time (see section 12).
2. Who can use Tchentchen
Tchentchen is a service for businesses. You must be at least 18, use it for your trade or business, and give accurate information when you sign up and keep it up to date.
3. Your account
Keep your password secret and your sign-in method secure. You are responsible for what happens in your account. Tell us at support@tchentchen.com right away if you think someone else has used it. One account can manage several stores.
4. Stripe and your payments
- To take payments, you need your own Stripe account and must accept Stripe’s terms (the Stripe Services Agreement).
- Payments go directly to your Stripe account. Tchentchen never holds, receives or moves your money. Stripe charges its own fees.
- Refunds, disputes, chargebacks and payouts are handled in your Stripe Dashboard and remain your responsibility.
- When you connect Stripe, you allow us to act on your Stripe account only to provide the service: create checkouts, read the payment details of your orders, and charge the after-purchase offers your shoppers accept. You can disconnect Stripe at any time.
5. The plugin
We give you a personal, non-exclusive, non-transferable and revocable right to install and use the Tchentchen plugin on the stores you operate, for as long as you use the service. Keep it up to date: an old version may stop working. Do not sell, share or modify the plugin, or try to extract its source code, except where the law allows it. Open-source parts of the plugin remain under their own licences.
6. Your store and your sales
You are the seller. You are responsible for:
- your products, prices, taxes, delivery rules and stock;
- the consumer law of the countries you sell to, such as the information you give shoppers and their withdrawal rights;
- your store’s terms and privacy policy, which must tell shoppers that payments are processed by Stripe through Tchentchen and, if you use them, explain the one-click offers and the background tracking option;
- checking your settings: the checkout uses the prices, taxes and delivery options of your store, so test it before you take real payments.
7. Upsells and after-purchase offers
You choose the products you offer and their discounts. Offers must be lawful and presented clearly. An after-purchase offer charges the shopper’s saved payment method only when the shopper accepts it, and the added product joins the same order. You handle the refunds of these products like any other sale.
8. Acceptable use
Do not use Tchentchen to:
- sell products or services that are illegal or that Stripe does not allow;
- mislead or defraud shoppers;
- break or test the security of the service, overload it, or access it by automated means other than our plugin;
- break the law or the rights of others.
9. Price
Tchentchen is free today: every feature, with no limit on stores or orders. If we introduce paid features or fees, we will email you at least 30 days before they apply. They will never apply to the past, and you can stop using Tchentchen before they start. Stripe’s own fees always apply.
10. Personal data
Our privacy policy explains how we handle personal data. For the data of your shoppers, you are the controller and we are your processor. This section is our data processing agreement. We:
- use your shoppers’ data only to provide the service, following these terms as your instructions;
- make sure the people who access it are bound by confidentiality;
- protect it with the security measures described in the privacy policy;
- use the providers listed in the privacy policy, and update that list before we add one, so you can object;
- help you answer your shoppers’ requests and meet your own obligations;
- tell you without undue delay if a breach affects your shoppers’ data;
- delete the data when the service ends, within 30 days, except backups replaced on a rolling basis;
- give you the information you need to show that these commitments are met.
If you need a signed version, write to legal@tchentchen.com.
11. Intellectual property
Tchentchen, its software, plugin, design and brand belong to us. Your store, products and data remain yours. You allow us to use your store’s content (such as product names, pictures and prices) only to show your checkout and provide the service. If you send us ideas or feedback, we may use them freely.
12. Availability and changes to the service
We work to keep Tchentchen available, but it may be interrupted, for example for maintenance or because of a provider such as Stripe or your hosting. We may change, add or remove features. We will give you reasonable notice of important changes, and at least 30 days’ notice by email before we stop the service.
13. Stopping and suspension
You can stop at any time: uninstall the plugin, disconnect Stripe, and ask us at support@tchentchen.com to delete your account.
We may suspend or close your account if you break these terms, if your use puts shoppers, Stripe or us at risk, or if the law requires it. We will tell you first when we can.
When the service ends, the plugin stops creating checkouts. Your orders stay in your store and your payments in your Stripe account. Sections 10, 11 and 14 to 19 still apply.
14. No warranties
Tchentchen is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will meet your needs or work without interruption or error. We are not responsible for Stripe, your e-commerce platform, other plugins of your store or your hosting.
15. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost sales, profits, data or goodwill. Our total liability for all claims about Tchentchen is limited to the greater of the amounts you paid us in the 12 months before the claim and 100 US dollars. Nothing in these terms limits a liability that the law does not allow us to limit.
16. Your responsibility towards us
You will defend us and cover our costs if a third party, such as a shopper or an authority, makes a claim against us because of your products, your store, your sales, or your breach of these terms or of the law.
17. Changes to these terms
When we update these terms, we change the date at the top of this page. For an important change, we email you at least 30 days before it applies. If you keep using Tchentchen after that, the new terms apply; if you do not accept them, stop using the service.
18. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States. Before going to court, write to legal@tchentchen.com so that we can try to settle the matter within 30 days. Any dispute that remains goes to the state or federal courts located in Wyoming, unless a law that cannot be set aside gives you the right to use another court.
19. General
These terms and the privacy policy are the whole agreement between you and us about Tchentchen. If one part is invalid, the rest still applies. Not enforcing a right is not giving it up. You may not transfer these terms without our consent; we may transfer them to a company that takes over Tchentchen. Neither of us is responsible for delays caused by events beyond reasonable control. We send notices to your account’s email address; send yours to legal@tchentchen.com. These terms may be translated: the English version prevails.
